​Partner Visa

The Spousal visas (Subclass 820/801 or 309/100) allow the partner or spouse of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia. The temporary Partner visa (subclass 820 or 309) is granted first, allowing the applicant to stay in Australia while the permanent Partner visa (Subclass 801 or 100) gets processed. The minimum requirements for this visa subclass are as follows
Relationship
​

In a marriage:
  • The applicant must be legally married to an Australian citizen, permanent resident or eligible New Zealand citizen.
In a de facto relationship: 
  • The applicant must be in a de facto relationship with an Australian citizen, permanent resident or eligible New Zealand citizen for at least 12 months before lodging the visa application. AND
  • The applicant and the sponsor must be at least 18 years old and not closely related. 
In all cases:
  • The applicant and the sponsor must be in a mutually exclusive relationship.
  • The relationship must be genuine and continuing.
  • The applicant and the sponsor should be living together.
  • If the applicant and the sponsor live apart, it should only be temporary.  ​
Sponsor

The Partner Visa sponsor must:
  • Be an Australian citizen, permanent resident or eligible New Zealand citizen.
  • Not have sponsored more than one other fiancé, de facto partner or spouse for migration to Australia. 
  • Not have sponsored a fiancé, de facto partner or spouse for migration to Australia within the last five years. 
  • Not have been sponsored for a Partner or Prospective Marriage Visa by someone else within the last five years. 
  • Provide a police clearance certificate to the Department of Home Affairs for each country where they have lived for more than 12 months during the last ten years.
  • Give consent to the Department of Home Affairs to disclose any conviction for a "relevant offence" to the visa applicant and any family member included in the application.
The sponsor may NOT be eligible to sponsor your visa application if they has been convicted for a relevant offence and/or has a significant criminal record. 

 Prospective Marriage Visa (Subclass 300)


The prospective marriage visa (subclass 300) allows the fiancé of an Australian Citizen, permanent resident or eligible New Zealand citizen to travel to Australia and get married. It is a legal requirement that the wedding must occur within nine months from the visa grant date. After the couple says "I Do", the applicant can apply for a partner visa. The minimum requirements for this visa subclass are as follows

Relationship 

The soon to be bride and groom must:
  • Be at least 18 years old. 
  • Not be closely related to each other. 
  • Be legally able and free to marry each other. 
  • Genuinely intend to get married within nine months from the visa grant date. The marriage can be either in Australia or Oversea. 
  • Have physically met each other and be personally known to each other. 
  • Genuinely intend to live together as a married couple. 
This visa is valid for nine months, and you must marry your sponsor within that time. You must be outside Australia when the visa is lodged and granted.
Sponsor

The Prospective Marriage Visa sponsor must:
  • Be an Australian citizen, permanent resident or eligible New Zealand citizen.
  • Not have sponsored more than one other fiancé, de facto partner or spouse for migration to Australia. 
  • Not have sponsored a fiancé, de facto partner or spouse for migration to Australia within the last five years. 
  • Provide a police check to the Department when requested.
  • Give consent to the Department to disclose any conviction for a "relevant offence" to the visa applicant and any family member included in the application.
