The TSS visa program serves as a lifeline for employers facing labor shortages by enabling them to sponsor skilled workers. In response, the government has introduced three distinct lists: the Short Term Skilled Occupation List (STSOL), the Medium and Long Term Strategic Skills List (MLTSSL), and the Regional Occupation List (ROL).
In essence, employers are typically eligible to sponsor overseas skilled workers only for occupations found on these three lists. The fundamental prerequisites for both the Short-term and Medium-term streams within this visa category are as follows:
The Employer/Sponsor

The Business Seeking to Sponsor an Applicant Must:
  • Operational Status: Be actively and lawfully operating in Australia; or
  • Overseas Operation: Be actively and lawfully operating overseas with the intent to:
    • Establish a business operation in Australia; or
    • Fulfill a contractual obligation.

Business Accreditation: Businesses have the option to seek accreditation status with the Department, granting them priority processing for all TSS nomination and visa applications.
Adverse Information: The sponsoring business should not have any adverse information known to the Department. This information encompasses, but is not limited to, violations of Commonwealth or State laws, such as immigration, industrial relations, or taxation.

The Nominated Position

The Nominated Position Must:
  • Genuine and Full-Time Role: Be a genuine and full-time position.
  • Within Business Entity: Fall within the sponsor's business entity.
  • Standard Employment Contract: Be employed under a standard employment contract.
  • Salary Requirements: Offer a salary of:
    • At least $70,000 per year and
    • At least the Annual Market Salary Rate (AMSR) for the nominated position.
  • Equivalent Employment Conditions: Maintain equivalent employment conditions compared to Australians in the same work and location.
  • Labour Market Testing (LMT): Have undergone Labour Market Testing, which means the sponsoring business made efforts to recruit a suitably skilled Australian for the position before seeking overseas sponsorship.
Visa Applicant

​The Visa Applicant Must:
  • Skills, Qualifications, and Work Experience: Possess skills, qualifications, and work experience that align with the requirements of the nominated position.
  • Work Experience: Have a minimum of two years of full-time work experience in the nominated position.
  • Genuine Work Intent: Demonstrate a genuine intention to work in the nominated position.
  • ​Regulatory and Licensing Requirements: Fulfill all regulatory and licensing prerequisites applicable to the nominated position.
  • Health Insurance: Maintain adequate health insurance coverage for the entire duration of the visa.
  • ​Health and Character Criteria: Satisfy the health and character criteria required for the visa to be granted.
​Short Term Stream

Additional Requirements:
  • Nominated Position on STSOL: The nominated position must be listed on the Short Term Skilled Occupation List (STSOL).
  • Genuine Temporary Stay: The applicant must genuinely intend to stay in Australia temporarily.
  • English Skills Criteria: The applicant is required to meet the English skills criteria.
  • Maximum Visa Duration: For the Short Term stream, the maximum visa duration is two years, unless an International Trade Obligation (ITO) applies to the position. Furthermore, the applicant can hold a maximum of two visas under this stream.
Medium Term Stream

Additional Requirements:
  • Nominated Position Eligibility: The nominated position must be listed on either the Medium and Long Term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL).
  • Regional Employment: If the nominated position is on the ROL, the place of employment must be in a regional area.
  • English Skills Criteria: The applicant is required to meet the English skills criteria.
  • Maximum Visa Duration: For the Medium Term stream, the maximum visa duration is four years.
